1. Acceptance of Terms

Welcome to AusomeNotes, a product of Ausome Software Publishing ("Company," "we," "our," or "us"). These Terms of Use ("Terms") govern your access to and use of the AusomeNotes mobile application and related services (collectively, the "Service").

By downloading, installing, accessing, or using AusomeNotes, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

We may update these Terms from time to time. Your continued use of the Service after any changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.

2. Description of Service

AusomeNotes is a personal organization and productivity tool designed to help parents manage and organize session notes related to their children's support services. The Service provides:

• Multiple input methods for capturing notes (text paste, photo capture with OCR, audio recording with transcription, and manual entry)
• AI-powered extraction of key information from notes
• Organization and storage of session notes by child, provider type, and date
• PDF report generation for personal record-keeping and sharing
• Multi-child support for families with multiple children
• Goal tracking across sessions

3. Eligibility

To use AusomeNotes, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction
• Be a parent, legal guardian, or authorized caregiver of the child(ren) whose information you enter into the Service
• Have the legal authority to agree to these Terms
• Not be barred from using the Service under applicable law

By using AusomeNotes, you represent and warrant that you meet all eligibility requirements.

4. User Accounts

4.1 Account Creation

To access certain features of AusomeNotes, you must create an account. You may register using your email address or through Google Sign-In. You agree to provide accurate, current, and complete information during registration.

4.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach

We are not liable for any loss or damage arising from your failure to protect your account credentials.

4.3 One Account Per User

Each user may maintain only one account. Creating multiple accounts may result in termination of all accounts.

5. Credits & Payments

5.1 Credit System

AusomeNotes uses a credit-based system for certain AI-powered features, including:

• Text extraction from pasted content
• Photo OCR (Optical Character Recognition)
• Audio transcription

Manual entry of notes does not require credits.

5.2 Purchasing Credits

Credits can be purchased through in-app purchases. All purchases are processed through the Google Play Store and are subject to their terms and conditions.

5.3 Credit Usage

Credits are deducted when you use AI-powered features. The credit cost for each feature is displayed before you confirm the action. Credits are non-transferable between accounts.

5.4 Refunds

Credit purchases are generally non-refundable. Refund requests for in-app purchases must be directed to the Google Play Store in accordance with their refund policies. We may, at our sole discretion, provide refunds or credits in cases of technical errors or service failures.

6. Subscriptions

6.1 Subscription Plans

AusomeNotes may offer subscription plans that provide additional features, benefits, or credit allowances. Subscription details, pricing, and features are displayed within the app.

6.2 Billing

Subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your selected plan). Your subscription will automatically renew unless you cancel before the renewal date.

6.3 Cancellation

You may cancel your subscription at any time through the Google Play Store. Cancellation will take effect at the end of your current billing period. You will retain access to subscription features until the end of the paid period.

6.4 Price Changes

We reserve the right to modify subscription prices. Any price changes will be communicated in advance and will apply to subsequent billing periods.

7. User Content & Data

7.1 Your Content

You retain ownership of all content you submit to AusomeNotes, including session notes, photos, audio recordings, and any other information ("User Content"). By using the Service, you grant us a limited license to process, store, and display your User Content solely for the purpose of providing the Service to you.

7.2 Responsibility for Content

You are solely responsible for:

• The accuracy and completeness of your User Content
• Ensuring you have the right to upload and use any content you submit
• Backing up your own data (we recommend exporting important records regularly)

7.3 Content About Children

By entering information about your child(ren) into AusomeNotes, you represent and warrant that you are the parent or legal guardian of such child(ren) or have obtained proper authorization from the parent or legal guardian to enter such information.

7.4 Data Privacy

Our collection, use, and protection of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Acceptable Use

You agree NOT to use AusomeNotes to:

• Enter information about children for whom you are not the parent, guardian, or authorized caregiver
• Upload content that infringes on intellectual property rights of others
• Transmit malware, viruses, or other harmful code
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the Service for any illegal purpose or in violation of any applicable laws
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated systems or bots to access the Service
• Resell, redistribute, or commercially exploit the Service without authorization
• Harass, abuse, or harm others through the Service

Violation of these rules may result in immediate termination of your account.

9. AI Features & Accuracy

9.1 AI-Powered Features

AusomeNotes uses artificial intelligence and machine learning technologies to:

• Extract text from images (OCR)
• Transcribe audio recordings
• Identify and extract key information from session notes

9.2 No Guarantee of Accuracy

We do not guarantee the accuracy, completeness, or reliability of any AI-generated content. The AI may misinterpret handwriting, audio, or context. Always review extracted information and make corrections as needed.

9.3 Your Responsibility

You acknowledge and agree that:

• AI extractions are suggestions and should be verified
• You are responsible for the accuracy of your final saved notes
• We are not liable for any decisions made based on AI-extracted information

10. Intellectual Property

10.1 Our Property

AusomeNotes, including its design, features, functionality, code, graphics, logos, and trademarks, is owned by Ausome Software Publishing and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.

10.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use AusomeNotes for your personal, non-commercial use in accordance with these Terms.

10.3 Feedback

If you provide us with feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without restriction or compensation to you.

11. Important Disclaimers

11.1 Not a Healthcare Service

AusomeNotes is a personal organization and productivity tool. It is NOT:

• A healthcare provider or medical practice
• A medical device or clinical tool
• A substitute for professional medical advice, diagnosis, or treatment
• A tool for making healthcare decisions
• HIPAA-compliant healthcare software

11.2 Not Medical Advice

Nothing in AusomeNotes should be construed as medical, therapeutic, or professional advice. The Service simply helps you organize notes and records. Always consult qualified healthcare professionals for any health-related concerns or decisions regarding your child.

11.3 Your Decisions

You are solely responsible for any decisions you make based on information stored in or generated by AusomeNotes. We do not recommend, endorse, or advise on any treatments, therapies, providers, or courses of action.

11.4 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Any defects will be corrected
• The Service will meet your specific requirements
• AI features will produce accurate results

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AUSOME SOFTWARE PUBLISHING, AUSOMENOTES, OR THEIR OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, use, or goodwill
• Any damages arising from your use or inability to use the Service
• Any damages arising from AI-generated content or inaccuracies
• Any unauthorized access to or alteration of your data

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY US DOLLARS ($50), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Ausome Software Publishing, AusomeNotes, and their officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any rights of another party
• Any claim that your User Content infringes intellectual property rights

14. Termination

14.1 Termination by You

You may stop using AusomeNotes at any time. To delete your account, please use the account deletion feature in the app or contact us at the email provided below.

14.2 Termination by Us

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include:

• Violation of these Terms
• Fraudulent or illegal activity
• Extended periods of inactivity
• Requests by law enforcement
• Discontinuation of the Service

14.3 Effect of Termination

Upon termination:

• Your right to use the Service immediately ceases
• Unused credits are forfeited and non-refundable
• We may delete your account and User Content
• Provisions that by their nature should survive (such as disclaimers, limitations of liability, and indemnification) will remain in effect

14.4 Data Export

We recommend exporting your data regularly. Upon request before termination, we will make reasonable efforts to provide you with a copy of your data.

15. Changes to Terms

We may modify these Terms at any time. When we make changes:

• We will update the "Last Updated" date at the top of this page
• For material changes, we will notify you through the app or via email
• Your continued use of the Service after changes constitutes acceptance

If you do not agree to the modified Terms, you must stop using the Service.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts located in the Philippines.
